Nothing is foolproof, but it is of my opinion third parties, affiliated or not, can be of great benefit to vendors. It's a damn shame we need to face this issue as it is, but responsibility comes first for both the vendors and consumers.

The idea of using a disclaimer placed by any link to an outside source of information is a good one. Stating that, "The opinions and views expressed by the author of this linked material do not necessarily reflect those of the owners of "XXX Kratom LLC," might serve as a legal point in a vendor's favor if he does feel it would be useful to provide access to outside information.

I myself am very fascinated by Kratom's natural benefits, be it what you must say. I also write articles of similar nature.

It deserves much more scientific study before receiving blanket demonization. Vendors have in fact had difficulties with authorities lately, to be made an example of and, another theory... the fact that it is imported and not indigenous to the US also makes way for easy propaganda and assumptions.

I find that vendors are being increasingly careful about linking to external sources because of the tightening stringency. I understand these should be kept as separate entities. Good looking out.

EDIT: It should also be noted that vendors who link to such articles should place a legal disclaimer where they neither endorse, condone or condemn the content on the foresaid website and that the views and opinions expressed are solely those of their webmaster.

This way they can still have the benefit of linking to helpful external sources. Not to say it's foolproof...

I think the fact that the FDA seized this shipment because of him posting a link to that article (great read and info Paul, as always) shows that Kratom is very much on their radar, and that all the vendors need to be super careful going forward. It's completely ridiculous but it's reality. :angry: I hope he gets his shipment back, but suspect it's going to be an uphill battle against the FDA. Keep us informed about how this turns out Paul. Thanks.

I got a PM the moment I got onto Facebook this morning from a fairly large, successful vendor who has had a large load seized by the FDA. He has hired a top attorney to represent his case, trying to get his product back.

He told me he had found out why the FDA had seized his kratom. It was because months ago he put a link to one of my pro-kratom articles on his company Web page. The FDA considered linking to my article as "making medical claims", which is forbidden because nobody is supposed to be consuming any of this kratom.

If you are selling kratom as a dietary supplement, and selling capsules (empty or full, they imply consumption), you fall under a more strict set of regulations, which you should comply with. For most vendors, however, it is simpler to just sell as a bulk botanical, with no instructions for use.

The main thing is to make your description of the purpose this kratom will serve match what the DHL's FDA specialist sees on your company Web site and any Facebook or other social media you use to market this product.

If you're wondering how I fit into all this...

I do a lot of writing about kratom. I am fascinated by the herb and its medical potential to replace so many common prescription medications. I write about kratom's ability to help those addicted to OxyContin, Percocets, Fentanyl, Morphine, and suboxone to kick their habit with little of the usual withdrawal symptoms.

You, as vendors, are not supposed to discuss these issues on your sales site, whether it is a Facebook page or your company Web site.

I love to have people read and share my articles, BUT, I just want to warn you that the FDA -- when they see a new vendor with a large quantity of kratom coming into Cincinnati or some other hub -- they may take a look at your Web site to see where this kratom is going to be sold.

If you say it's for making incense, they'll be looking for incense for sale on your Web site or FB page. I think it is best not to say anything about it; it is a bulk botanical being sold with no claims made. It is not approved by the FDA for human or animal consumption.

If you say you're importing it for Research standards, or whatever, you want that to be what they find on your Web site -- NOT one of my articles about the pain-relieving benefits of kratom for fibromyalgia, or for energy, or for quitting heroin, etc.

I hate to discourage you from posting any of my articles (unless it is one about the politics of kratom), but I don't want you to get in trouble like the vendor who messaged me on Facebook.

That's what's cool about this forum and the blog connected to it. All this info is here to educate your buyers about how to use kratom, so you don't need to tell them on your site.

You just sell kratom. You don't know what people do with it. You don't want to influence them to do something that has not been approved by the U.S. Food & Drug Administration.

So, be sure to make use of the blog and this forum to keep your importing running smoothly and trouble-free. And don't post my articles on your Web site or FB group page if you're doing any selling there.
